EU Agency for Fundamental Rights received its mandate with Council Regulation (EC) No 168/2007 of 15 February 2007 establishing a European Union Agency for Fundamental Rights. Its objective is to provide institutions, bodies, offices and agencies of the EU and its member states, when implementing Union law, with relevant assistance and expertise. Its tasks include conducting policy driven and policy relevant research and analysis, communicating the results and raising awareness.

The Charter of Fundamental Rights was formally proclaimed in Nice in December 2000 by the European Parliament, Council and Commission and on 1 December 2009, with the entry into force of the Lisbon Treaty, the Charter was given binding legal effect equal to the Treaties. The Charter entrenches all the rights found in the case law of the Court of Justice of the EU; the rights and freedoms enshrined in the European Convention on Human Rights; other rights and principles resulting from the common, constitutional traditions of EU countries and other international instruments. It creates legal certainty in the EU, by making fundamental rights clearer and more visible.

This brief summarises the key developments in relation to rule of law in view of EU accession in North Macedonia for the period January – March 2022. The brief is based on regular monitoring of the key institutions, desk review of available information as well as requests for free access to public information.

This Shadow Report streamlines in a coherent unity all findings, conclusions and recommendations deriving from monitoring the areas covered by Chapter 23 -Judiciary and Fundamental Rights. This is the fifth Shadow Report published by the European Policy Institute-Skopje (EPI) while taking into consideration the comments and opinions of the 23 Network members. The previous four Shadow Reports cover the period from October 2014 to July 2015, then the period from July 2015 to April 2016, the period from May 2016 to January 2018 and the period from June 2018 to March 2019.

Project “Network 23+” implemented by the European Policy Institute-Skopje and the Helsinki Committee for Human Rights aims at providing structured contribution of the civil society in monitoring and assessing the policies included in Chapter 23 of the EU Acquis – Judiciary and Fundamental Rights. This report unifies all the findings, conclusions and recommendations that resulted from the monitoring of the areas structured in Chapter 23 – Judiciary and Fundamental Rights into a single coherent entirety. In fact, this is the third Shadow Report published by “Network 23”. The previous two cover the periods of October 2014-July 2015 and July 2015-April 2016. This report encompasses the period between the beginning of May 2016 and the end of January 2018. The report’s period has been extended in order to correspond to the new cycle of European Commission reports, which are to be released in April.

This report is a sublimate of the conclusions and recommendations drafted on the basis of the monitoring of the areas structured in Chapter 23. The report was drafted during a period of deep political crisis, which resulted from the unsuccessful implementation of the Przino Agreement, as well as the failure to effectuate its main provisions, which were connected with the reform priorities outlined on the basis of the Priebe Report.
